General Terms and Conditions for using the services of arabillustrated.com
1. Scope and Subject Matter of the Agreement
These Terms of Use govern the legal framework for using the online platform and the associated services of arabillustrated.com (hereinafter "Provider"). The subject matter of the agreement includes the provision of a platform for illustration, art, design, and cultural exchange in the field of visual arts.
The platform serves to present, sell, and discuss illustrations and visual art from various cultures. It promotes creativity and intercultural dialogue. The Provider provides the technical infrastructure for this purpose.
2. Rights and Obligations of Users
Users agree to use the platform only within the framework of applicable laws and these Terms. They are responsible for the accuracy of their information.
- Uploaded content (illustrations, artworks, texts) must respect the user's copyright and usage rights.
- It is prohibited to distribute content that is unlawful, offensive, or misleading.
- Commercial use of the platform for selling one's own works requires complete registration.
- Users grant the Provider the non-exclusive right to use uploaded works for the purpose of display on the platform.
2.1. Account Obligations
Each user is responsible for the security of their access. If unauthorized use is suspected, the Provider must be informed immediately.
3. Services, Availability, and Changes
The Provider strives for high availability of the platform. However, there is no claim to uninterrupted usability. Planned maintenance work may temporarily restrict accessibility.
The Provider reserves the right to adapt and further develop the platform's offerings, functionalities, and these Terms of Use. Significant changes to these Terms will be communicated to users in a timely manner. Continued use of the services after changes take effect constitutes consent.
4. Liability Limitations
The Provider's liability is limited to intent and gross negligence, to the extent permitted by law. For ordinary negligence, the Provider is liable only in case of a breach of essential contractual obligations (cardinal duties) and only for the foreseeable, typically occurring damage.
- The Provider assumes no liability for the accuracy, completeness, or timeliness of content posted by users.
- Liability for lost profits, data loss, or indirect damages is excluded.
- The aforementioned liability limitations do not apply to damages resulting from injury to life, body, or health.
Users are liable to the Provider for all damages and costs arising from their violation of these Terms of Use or applicable rights of third parties.
5. Payment Terms and Right of Withdrawal
For chargeable services (e.g., premium memberships, commission models), the prices and payment terms published on the services.html page at the time of contract conclusion apply.
Users have the right to withdraw from chargeable contracts within 14 days of contract conclusion without giving any reason. The withdrawal policy is viewable on the platform. In case of withdrawal, payments already made will be refunded.
5.1. Due Date and Payment Default
Invoices are due immediately upon receipt. In case of payment default, the Provider reserves the right to block access to chargeable services.
6. Termination of Use
Users can cancel their account and the use of services at any time without observing a notice period.
The Provider is entitled to block or terminate the use of an account with immediate effect in case of serious violations of these Terms or applicable law. A minor violation initially justifies a warning.
After termination of the account, the Provider retains the right to store user-generated content in a backup for a reasonable period but has no obligation for permanent retention.
7. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with these Terms is, to the extent legally permissible, the registered office of the Provider.
If a provision of these Terms of Use is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose.
